A government college lecturer in Maharashtra was declared “surplus” in 2001 and, under state policy, had to be reassigned to an equal post elsewhere — which meant he was entitled to another Lecturer job, and that’s exactly what he got, working there until he retired in 2024. But he also fought a long legal battle claiming he should have been given the bigger role of “Head of Department” instead, arguing he was senior enough to qualify for it and that it paid the same as a Lecturer anyway. The High Court agreed with him, but the Supreme Court overturned that, explaining that being eligible for a promotion and being automatically entitled to one are two very different things — the surplus-employee policy only guaranteed him his old-level job back, not a bigger one, no matter how qualified he was or how similar the pay looked.
