A petition filed by two senior citizens (including a retired army officer) to cancel a criminal case (FIR) registered against them for serious offences including sexual assault. The Delhi High Court dismissed the petition, ruling that the evidence and defenses they raised—such as call detail records, entry registers, and claims of false implication due to a property dispute cannot be evaluated to throw out the case at this initial stage, and must instead be properly tested during a regular trial.
A female security guard working at a farmhouse in Chhattarpur filed a police complaint alleging that in September 2022, the owner (Petitioner No. 1) gave her a drugged cold drink causing her to lose consciousness, and a retired army officer who is his relative (Petitioner No. 2) later threatened and sexually assaulted her. After finishing her deployment and returning from a trip to Uttarakhand, she reported the matter to her son and the police, leading to a chargesheet for sexual assault and related offences.
The petitioners denied the allegations and asked the High Court to throw out the case, arguing that call records, entry-exit registers, their old age, and medical ailments proved they were not present at the time or capable of committing the crime, and claiming they were falsely implicated due to an ongoing property dispute over the farmhouse. However, the court ruled that these defenses required a detailed trial and could not be used to dismiss the charges prematurely.
